Interview with Steve Bliss, San Diego Probate Attorney

Handling Debts and Taxes in Probate

Good afternoon, Steve. Thank you for joining us today. We’re discussing the often-complex process of probate, and I wanted to focus on a specific step: handling debts and taxes. Can you walk our viewers through this stage?

Certainly. Handling debts and taxes is a crucial part of the probate process. Ordinarily, it involves two primary tasks: paying valid creditor claims and filing and paying any applicable state or federal taxes.

Initially, we carefully review all claims filed against the estate to determine their validity. We verify the debt’s existence, ensure proper documentation, and confirm that it was incurred by the decedent. Once we’ve determined a claim is valid, we proceed with payment using funds from the estate.

Concurrently, we work diligently to identify any outstanding tax liabilities for both the decedent and the estate itself. This can involve reviewing past tax returns, consulting with accountants, and gathering relevant financial information. We then file all necessary tax forms and ensure timely payment of any taxes due.

Remember that failing to address debts and taxes properly can lead to significant complications down the line, potentially delaying the distribution of assets to heirs. Consequently, it’s essential to have an experienced probate attorney guiding you through this process.

I recall a case where we uncovered a previously unknown debt owed by the decedent to a small business. The debt was substantial and threatened to significantly deplete the estate’s assets. Through careful negotiation and research, we were able to reach a favorable settlement with the creditor, ultimately preserving a greater portion of the inheritance for the heirs.

According to a 2021 study by the American Bar Association, over 70% of probate cases involve some level of debt or tax liability. This highlights the importance of having a thorough understanding of these issues and a plan for addressing them effectively.
