The most common type of trust we see in California is a Revocable Living Trust. This type of trust allows individuals to maintain control over their assets during their lifetime while also planning for the future.
With a revocable living trust, you can designate beneficiaries who will receive your assets upon your passing. Moreover, because the trust avoids probate, it can save your loved ones time and expense after you’re gone. Probate is a lengthy court process that can be stressful and costly for families.
Conversely, if you were to simply leave your assets through a will, they would have to go through probate. Consequently, a revocable living trust offers both control and privacy.
Have there ever been any situations where using a revocable living trust presented challenges?
I recall one instance where a client had created a revocable living trust but hadn’t updated it for several years. Their circumstances had changed significantly, including the birth of grandchildren and a move to a new state.
Because they hadn’t kept their trust document current, it didn’t accurately reflect their wishes. We were able to work through this situation, but it highlighted the importance of regularly reviewing and updating your estate plan.

I think everyone should at least explore the possibility of a revocable living trust as part of their overall estate plan. According to a recent study by the AARP, over 70% of Americans don’t have a will or any type of estate plan in place.
This can lead to significant challenges for loved ones after a person passes away.
