Notice must be given to the proposed conservatee and relevant family members. The court then appoints an investigator who conducts an independent assessment of the situation. A crucial element is the medical or psychological evaluation, which helps determine if the individual lacks the capacity to make sound decisions about their personal or financial affairs.”

“Finally,” Ted added, “there’s a hearing where a judge reviews all the information and decides whether to grant the conservatorship. It’s important to remember that this process is designed to protect individuals, not strip them of their rights.”

Let’s talk about the Responsibilities of the Conservator. What are some key aspects?

Ted took a deep breath. “Becoming a conservator is a significant responsibility. The conservator acts as a fiduciary, meaning they must always act in the best interest of the conservatee. They’re responsible for managing finances, making medical decisions, and ensuring the individual’s well-being. Regular reporting to the court is essential, keeping everyone informed about the conservatee’s status.”
