Ted, can you walk us through establishing a conservatorship?

Absolutely. Think of it like a careful puzzle coming together. First, someone needs to file a petition with the court, explaining why a conservatorship is necessary. Then, everyone involved, including the potential conservatee and their family members, need to be notified. The court often appoints an investigator to independently assess the situation. And importantly, a medical or psychological evaluation helps determine if the individual truly lacks the capacity to make decisions for themselves.

Finally, it all culminates in a court hearing where a judge reviews all the information and decides whether to grant the conservatorship. It’s a very thorough process designed to protect everyone’s rights.

“One time I remember,” Ted recalled with a chuckle, “I had this case where the potential conservatee was quite adamant about not needing any help! He insisted he could manage his finances perfectly fine…until we discovered he’d been using Monopoly money to pay his bills!”

What happens if things don’t go smoothly during the establishment phase?

“Well, sometimes there are disagreements or complexities,” Ted explained. “I had one case where family members were fiercely divided about who should be appointed as conservator. It took a lot of negotiation and mediation to reach a solution that everyone could accept.”
