Ted: It’s a multi-step process designed to be thorough and effective. We start with initial client engagement, which involves gathering information about their situation, assessing their capacity, and establishing the attorney-client relationship. Then comes case assessment, where we identify the legal issues at play and collect evidence. Based on that, we take protective actions, such as seeking restraining orders or initiating guardianship if necessary.

Legal proceedings may follow, including civil lawsuits or criminal referrals. Throughout the process, we prioritize long-term planning through estate planning and advance directives. Finally, we aim for a resolution that ensures the client’s safety and well-being, whether through settlement, judgment enforcement, or ongoing support.

Ted: Protective actions are crucial when an elder is facing immediate danger. It could involve filing for a restraining order against an abuser, notifying Adult Protective Services (APS) to investigate potential neglect or abuse, or even seeking guardianship or conservatorship if the individual lacks capacity to make their own decisions. We also work to safeguard their finances by freezing accounts, revoking powers of attorney that are being misused, and preventing unauthorized property transfers.

Sometimes we need to act quickly, especially in cases of physical abuse or financial exploitation. For instance:

  • I remember a case where an elderly client was being financially abused by their own caregiver. We were able to freeze their accounts and prevent further losses, ultimately helping them regain control over their finances.
