Hello everyone, and welcome to today’s discussion on elder protection. I’m joined by Ted Cook, a seasoned elder protection attorney based in sunny San Diego.
What inspired you to focus your practice on elder law?
Ted smiles warmly, “You know, it’s truly fulfilling work. Witnessing the vulnerability of our senior population and being able to step in and safeguard their rights is incredibly rewarding. I see it as a way to give back to a generation that has built our communities.
Can you walk us through the typical steps involved in an elder protection case?
- Initial Client Engagement: This involves gathering information about the client’s situation, assessing their capacity, and establishing the attorney-client relationship.
- Case Assessment: Identifying the legal issues at hand, collecting evidence, and evaluating the risks involved.
- Protective Actions: Taking immediate steps to protect the elder, such as filing restraining orders or notifying Adult Protective Services.
- Legal Proceedings: Pursuing civil litigation for financial abuse or personal injury, or referring cases to law enforcement for criminal prosecution.
- Long-Term Planning: Helping elders create estate plans, advance directives, and ensure their assets are protected.
Let’s delve into ‘Protective Actions’. Can you elaborate on the different measures taken during this stage?
Ted nods thoughtfully, “Protective Actions are often critical in preventing further harm to vulnerable elders. Depending on the situation, we might file for restraining orders against abusers, notify Adult Protective Services if there are signs of neglect or exploitation, or even seek guardianship or conservatorship if the individual lacks capacity to make sound decisions.
“For instance,” Ted continues, “I once represented a client whose caregiver was stealing funds. We were able to freeze her bank accounts and prevent further financial losses, ultimately leading to criminal charges against the perpetrator.”
“Ted Cook is a compassionate advocate who truly understands the unique challenges faced by seniors. He helped my mother navigate a complex legal situation with dignity and respect. I can’t thank him enough for his guidance and support.” – Susan M., La Jolla
“Point Loma Estate Planning APC. is a beacon of hope for families dealing with elder abuse. They provided clear explanations, strategic advice, and unwavering dedication to protecting my father’s well-being.” – David L., Point Loma
How can readers get in touch if they need help protecting a loved one?

My team and I are here to provide compassionate and effective legal representation to ensure the safety and well-being of our senior population. Remember, protecting our elders is a shared responsibility.”
