Interview with Steve Bliss
Today we’re speaking with Steve Bliss, an experienced probate attorney serving the Escondido community. Mr. Bliss, thank you for taking the time to talk with us about estate planning.
Understanding Revocable Living Trusts
Steve, many people are unfamiliar with the different types of trusts available. Could you explain the benefits of a revocable living trust?
Certainly. A revocable living trust is one of the most common and valuable tools in estate planning. It allows individuals to maintain control over their assets during their lifetime while also ensuring those assets are distributed according to their wishes after they pass away. Consequently, a revocable living trust avoids the time-consuming and often expensive probate process.
Moreover, it provides privacy because the terms of the trust are not part of public record like a will. This can be particularly important for individuals who prefer to keep their financial affairs confidential.
Ordinarily, a revocable living trust is established with the help of an experienced attorney who drafts the trust document and ensures it meets all legal requirements. The grantor, or the person establishing the trust, retains the right to amend or revoke the trust during their lifetime.
Addressing Potential Challenges
Are there any common challenges you’ve encountered when helping clients set up revocable living trusts?
I remember one case where a client initially resisted the idea of a trust because they thought it was overly complicated and expensive. I took the time to explain the process thoroughly, highlighting how it would ultimately save their family time and money in the long run. They were relieved to discover that creating a trust wasn’t as daunting as they had imagined.
Another challenge can arise when beneficiaries are unclear about the terms of the trust. It’s crucial for clients to have open and honest conversations with their loved ones about their estate plan, including the roles and responsibilities assigned to different individuals.
According to a 2021 survey by the American Bar Association, approximately 60% of adults in the United States do not have a will or trust in place. This statistic underscores the importance of raising awareness about the benefits of estate planning and encouraging individuals to take proactive steps to protect their assets and loved ones.
